EdSource: California judge rejects injunction to halt distributing billions to repair school facilities

Alameda County Superior Court Judge Patrick McKinney denied plaintiffs’ request for a temporary injunction but found “some reasonable probability” that they will succeed at trial on their equal protection claim—a significant early signal in a case that’s been more than two decades in the making. “It’s heartening to see that the judge affirms the claim is serious, and we look forward to the trial,” said John Affeldt, Managing Attorney at Public Advocates.
The state has indicated it will move to dismiss the case; a status conference is set for mid-July, where the parties will discuss scheduling—Public Advocates is pushing for a trial as early as next year.
